Buffalo, New York —The preliminary hearing for a lawsuit filed against the Elmwood Village Hotel proposal in Buffalo, New York as well as the City of Buffalo has been postponed indefinitely and will take place “as needed” pending the resubmission of the proposal by Savarino Construction also of Buffalo. A request was made to New York State Supreme court Judge Justice Rose Sconiers, the judge to preside over the case, to discuss a “timetable” for resubmission, but the court “decided not to,” said attorney Arthur Giacalone who represents the plaintiffs in the lawsuit.

The hotel would require the demolition of at least five properties, 1109-1121 Elmwood and would cause the closure of several businesses. Already, two businesses, Skunk Tail Glass and Six Nations Native American Gift Shop have relocated, outside the Elmwood Strip. Don apparel, H.O.D. Tattoo and Mondo Video still remain on Elmwood; however, Mondo Video is planning on moving to a new location. The hotel will be 72 rooms and will cost at least 7 million dollars to build. Wyndham Hotels is expected to be the owner/operator of the hotel. The properites are currently owned by Hans Mobius. Two other properties, 605 and 607 Forest might also be part of the proposal. 605 Forest is owned by Pano Georgiadis, owner of Pano’s Restaurant on Elmwood Avenue in Buffalo. 607 Forest is owned by Mobius.

“There’s no new [court] date. The next appearance will be as needed,” said Giacalone.

The proposal was withdrawn by Savarino on July 13, 2006 to undergo “a do-over” and according to the Buffalo News, “shed the lawsuits” against the proposal; however, so far the proposal has “not yet” been resubmitted, but could be in about a “week.”

“With Council being out of session we have a bit of time [before resubmitting]. [We will] Probably resubmit] in a week or so,” said Sam Savarino, CEO of Savarino Construction.

“We welcome some discourse on this project and while we realize that, in all likelihood, we will not make everybody happy, we hope we can develop a consensus that what we provide on that corner will be something that is an enhancement to the neighborhood and the community. Better to have that decided (again?) in a public forum and through the approval process than through a debate over points of law in a courtroom,” added Savarino.

Despite the withdraw of the proposal, Giacalone states that the lawsuit his clients filed is still in effect due to the re-zoning of the properties, which he says are still in place and that he is “frustrated” that his client’s “day in court” has been delayed continuously by Savarino and the city.

Savarino believes that the re-zoning of the properties are “not in effect” because the proposal was withdrawn. He also stated that he is “unsure” on a decision to request the rezoning again because the “city suggested” the rezoning “last time.”

“We have pulled the request [proposal] so I would suppose it [the rezoning] is not in effect. We are as of yet unsure of whether or not to request rezoning of all the parcels. We are communicating with the City on this. You may recall that the City suggested this to us last time. We want to make sure we are doing the correct thing – and the proper thing. I am not sure whether I have a clear indication of that at this juncture,” said Savarino.

Savarino was asked if the proposal was going to be resubmitted or not, but did not answer the question.

Giacalone states that there may be several resons as to why “a new application has not been filed. Is Savarino having a hard time coming to an agreement with Mobius? Has Wyndham Hotels backed out? Is Savarino negotiating with Pano to buy the [605] Forest Avenue property?”

Buffalo’s Common Council is scheduled to meet on September 9, 2006 after Summer recess.

Riverview’s Dark Day

Friday night marked four years since the horrible night in March 2018 when Riverview, Florida saw one of the nation’s most horrifying, most heinous familicides in modern US history. There are no words to describe how traumatic and painful it must have been for Ronnie IV, who was only eight at the time of the attacks, perpetrated by his biological father. Now, Ronnie IV is 12 and thriving. One hour, Ronnie was having a normal second grade weekend Sunday, a Sunday that had presumably been pretty good up to that point. For 98.8% of that Sunday, the third Sunday of March 2018, he had a normal day. He was sitting in his bed in his room with his 9-year-old sister when all of a sudden, he heard his parents arguing loudly about religion. Ronnie IV described this as the worst argument he had ever heard between his parents, so this was his first clue that this night was about to take a terrible turn. But it is highly unlikely he could foresee the sheer magnitude of what would happen over the next twenty brutal minutes.

At 11:43 p.m. EDT that night, Ronnie IV’s parents, Ronnie III (father) and Kenyatta Barron (mother) got in an argument, and Ronnie III smacked Kenyatta with the side of a gun. Kenyatta ran into a closet in the sister’s room for shelter, but this did not last long. Ronnie III then chased Kenyatta into the front yard, where Ronnie III shot her to death. Ronnie III ran back into the home. Ronnie III, Ronnie IV, and the boy’s sister were in the garage when Ronnie III axed the sister to death. Ronnie IV saw tears and blood in his sister’s face. The sister was disabled; she was mute, so she could not scream. Seconds after killing Ronnie IV’s sister, Ronnie III turned on him. Ronnie III went to the kitchen to get a knife and stabbed him many times, leaving him critically injured. Then, the father set the home on fire, leaving both kids there to die. Ronnie III’s motive for the fire was to destroy all evidence of their existence, as Ronnie III considered Kenyatta to be the “devil” and the kids “the devil’s kids” when Kenyatta refused to convert to Islam. However, Ronnie IV, despite his pain, managed to escape the house in time and flag down a police officer and say, “My father shot my mother.” Ronnie III was arrested, while his son Ronnie IV was transported to a hospital. Despite extremely serious injuries, Ronnie IV miraculously recovered. Even the cop that saved his life was surprised, after visiting later that month, that the boy was even still alive, given the extent of the stab wounds and burns. By November 2019, when he was ten, he was adopted by the cop and his wife. The cop was named Michael Blair, so Ronnie’s current name is Ronnie Blair.

The criminal proceeding for the boy’s abusive father began on June 14, 2021. On June 16, 2021, Ronnie III cross-examined Ronnie IV.

  • Father: “Did I hurt you that night of this incident?”
  • Son: “Yes.”
  • Father: “I did? And how did I hurt you?”
  • Son: “You stabbed me.”

On July 23, 2021, Ronnie III was sentenced to life in prison without the possibility of parole. Judge Michelle Sisco, upon handing down this sentence, called this the worst case she had ever seen in 19 years of being a judge. Michelle has seen stabbings, drownings, and DUI manslaughter cases, so she is not saying this lightly. Ronnie IV, the sole survivor of the March 2018 family massacre, is determined to move forward in life and not let the horrific events of that night define him. Although he has two new adoptive parents in a new home he now calls “home”, he will never forget his mother. And as much as he loves his adopted siblings, he will never forget his sister. Looking back to before the March 2018 tragedy, he has many memories of his mother and sister that are very positive.

“She was just a good mom. We did like a lot of things together. She was nice, pushed me on the swing, made me some good wings,” Ronnie said of his mom in the video.

“My sister, she couldn’t talk but she could still move her head, so I learned sign language,” he added. “She was very nice.”

Canterbury farmers to get aid because of snow

The New Zealand government officials have announced that it will give NZ$160,000 in aid to help farmers who were affected by the huge amounts of snow in Canterbury, New Zealand two weeks ago.

The aid package will provide four regional offices for co-ordination, food supplies and ongoing support.

The Federated Farmers for mid Canterbury say that the aid will be a start to what looks like a tough winter. President of the mid Canterbury Federated Farmers Rupert Curd says, “It is too early to say exactly how much help the relief package will provide.”

The snow has not yet reached a crisis point.

The Insurance Council has estimated the cost of the snow storm has reached $35 million so far. Chief Executive of the Insurance Council says, “There has been damage to homes, commercial premises both on farms and in town and vehicles. Businesspeople who have been without power are also claiming for loss of income.”

The Minister of Agriculture Jim Anderton has said that they are not ruling out giving further aid.

No matter where you live or travel, sun exposure is part of your life. Medical studies show that too much sun can be dangerous, even deadly. Children are more susceptible than adults to the unhealthy effects of too much sunshine. How can you protect your family? Can your kids use the same sunblock that you use?

The simple answer to the question is ‘yes’ – with some special guidelines.

* Chemical Exposure

Recent testing of adults in several countries has shown high concentrations of many chemicals in their bloodstreams. Several of these chemicals are known carcinogens. We absolutely MUST reduce the chemical exposure of our children.

* Non-Chemical Sun Protection

Although in the strictest sense, titanium dioxide and zinc oxide preparations are actually sunblocks, manufacturers often use the terms ‘sunblock’ and ‘sunscreen’ interchangeably. As a consumer, you must read labels to ensure that you get what you pay for.

Titanium dioxide and zinc oxide sun products provide a chemical-free way to protect your children. Nowadays, there are easy-to-apply lotions and creams. Kids don’t have to look like ghosts on the beach because their skin has been protected by a zinc oxide sunblock. Added bonuses: these non-chemical products are less likely to cause skin irritations or allergic reactions – and they start to work immediately (no waiting period necessary).

* Start at Birth and Continue

Babies have extremely sensitive skin. Sun protection must begin from birth and continue throughout the life of your child. Whenever you go outdoors, ensure that most of the baby’s skin is covered. Use stroller hoods, umbrellas, blankets, towels, or clothing for shade. Exposed areas should always be protected by a good UVA/UVB-blocking sunscreen with an SPF of 15-30. Avoid the outdoors during hours of peak sun concentration – between 10 a.m. and 2 p.m.

* Skin Cancer is Only One of the Problems

Skin cancer is a well-known result of too much sun exposure. However, many other conditions result from soaking up the sun. Skin aging and wrinkles are the least of the undesirable side effects. Some people develop actinic keratosis – an ugly skin condition with raised red growths that may precede skin cancer. (Search ‘Google Images’ for ‘actinic keratosis’ to see what this horrible condition looks like.)

Eyesight may be damaged, resulting in cataracts or other eye conditions. One’s immune system may be compromised, culminating in a constant barrage of colds, flu, and other viral or bacterial infections of the body.

* Water Magnifies the Sun

Not only does water dilute sunscreen or wash it off the body, it acts like a magnifying glass on the skin’s surface. Swimming may be fun – but the sun glancing off the waves and back into the eyes can cause temporary or permanent vision problems. When you are at the beach, insist that your children wear sunglasses, sun hats, and beach cover-ups. If it’s too warm for cover-ups, make sure that every inch of skin is protected by sunblock – and reapply frequently (especially when they exit the water). Sun can even make its way through clothing!

* Are Sprays Better than Lotions?

The ingredients are always the primary consideration when purchasing sun protection. After that decision has been made, choose whatever works best for your kids. Be sure to pay extra attention to sensitive areas like the nose, ears, and previously unexposed skin.

* Be Wary When Changing Brands

Try a new sun product on a small area of sensitive skin to see if it causes a rash. A small patch on an inside upper arm works well. If no rash develops, you can usually assume that it is safe to apply to the rest of your child’s body.

* Don’t Trust Cloud Cover

A cloudy sky does not mean that it’s safe to spend hours outdoors without sun protection. UVA and UVB rays bounce around in the air from water molecule to water molecule until they penetrate the cloud cover. The concentration of sunlight is reduced – but the harmful rays are still there.

* The Sun Doesn’t Care About the Equal Rights Amendment

Fair skinned, blonde girls are more likely to suffer from the ill effects of sun exposure than are darker skinned or black boys. Parents of all children should be vigilant, however. Even dark-skinned children will be adversely affected by good ol’ Sol.

* Global Warming Increases the Risk

Unless everyone develops (and sticks to) a rigid sun protection program, global warming (accompanied by lighter clothing) will cause more sun damage every year.

Judges rule patrons may sue nude bars for lap-dance overcharges

A three-judge Texas Court of Appeals ruling will allow men who were overcharged at nudie clubs to sue for refunds and damages.

The two plaintiffs, Paul Brian Meekey and Michael Fulmer, had their cases heard because they were charged more than a regular lap dance fee when they used a credit card, typically $25 for a $20 dance.

“Texas law is pretty clear that you cannot charge someone extra for using a credit card,” said Sandra Krider, an attorney for the patrons. “The fact that they are strip clubs shouldn’t mean they get away with it.”

A lawyer for the businesses, Rick’s Cabaret and the Men’s Club, argued a case based on the type of employment the ladies agreed to perform.

“Since the dancers are independent contractors and not employees of the club, the clubs are not the ones selling the dances,” said attorney Albert Van Huff.

But the men’s attorneys said the win could potentially become a class-action suit with many hundreds of men claiming their day in court. That could present a problem for other patrons who may not want their name and their use of a credit card at a nudie bar released in court transcripts.

“They are going to want the (strip) clubs’ credit card companies to give them the names of all the different people who have charged dances there,” said Van Huff.

The 14th Court of Appeals, a Texas court with headquarters in Houston, had reversed a ruling of a lower trial judge that this case should be heard before the state Finance Commission instead of in a judicial proceeding. The case was sent back to be tried again.

150,000 street vendors in India shown how to avoid causing ‘Delhi belly’

The All India Institute of Hygiene and Public Health has begun a campaign to instruct street vendors in India how to safely prepare food for their customers to avoid inflicting ‘Delhi belly’–severe diarrhea–which afflicts about half of the visitors to the region. Over 150,000 “stall wallahs” in Calcutta will be shown how to properly prepare dishes such as jhalmuri (a rice, tomato, and onion dish) and ghughni (a chick pea curry dish).

“Do not set up your stall in the middle of a rubbish dump, drain or sewage channel,” the report recommends. “Wash your hands before cooking and do not let large swarms of flies settle on food displays.”

“One of the tips we’ve been given is to wear aprons,” Banahari Saha, a stall operator on Camac Street, in Calcutta, told UPI. “We’ve also been told how important it is to make sure the water is clean and uncooked food is protected from flies,” he said.

The campaign is also sponsored by the World Health Organization. Tourists will be given maps pointing to street vendors who have been approved by the All India Institute.

“My customers say they’re happy with the changes I’ve introduced,” Saha told UPI.

HIV-positive man receives 35 years for spitting on Dallas police officer

An HIV-positive man was sentenced to 35 years in prison Wednesday, one day after being convicted of harassment of a public servant for spitting into the eye and open mouth of a Dallas, Texas police officer in May 2006. The United States Centers for Disease Control and Prevention says that no one has ever contracted HIV from saliva, and a gay-rights and AIDS advocacy group called the sentence excessive.

A Dallas County jury concluded that Willie Campbell’s act of spitting on policeman Dan Waller in 2006 constituted the use of his saliva as a deadly weapon. The incident occurred while Campbell, 42, was resisting arrest while being taken into custody for public intoxication.

“He turns and spits. He hits me in the eye and mouth. Then he told me he has AIDS. I immediately began looking for something to flush my eyes with,” said Waller to The Dallas Morning News.

Officer Waller responded after a bystander reported seeing an unconscious male lying outside a building. Dallas County prosecutors stated that Campbell attempted to fight paramedics and kicked the police officer who arrested him for public intoxication.

It’s been 25 years since the virus was identified, but there are still lots of fears.

Prosecutors said that Campbell yelled that he was innocent during the trial, and claimed a police officer was lying. Campbell’s lawyer Russell Heinrichs said that because he had a history of convictions including similarly attacking two other police officers, biting inmates, and other offenses, he was indicted under a habitual offender statute. The statute increased his minimum sentence to 25 years in prison. Because the jury ruled that Campbell’s saliva was used as a deadly weapon, he will not be eligible for parole until completing at least half his sentence.

The organization Lambda Legal (Lambda Legal Defense and Education Fund), which advocates for individuals living with HIV, says that saliva should not be considered a deadly weapon. Bebe Anderson, the HIV projects director at Lambda Legal, spoke with The Dallas Morning News about the sentence. “It’s been 25 years since the virus was identified, but there are still lots of fears,” said Anderson.

The Dallas County prosecutor who handled the trial, Jenni Morse, said that the deadly weapon finding was justified. “No matter how minuscule, there is some risk. That means there is the possibility of causing serious bodily injury or death,” said Morse. Dallas County District Attorney Craig Watkins stated: “If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.”

Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.

A page at the CDC’s website, HIV and Its Transmission, states: “HIV has been found in saliva and tears in very low quantities from some AIDS patients.” The subsection “Saliva, Tears, and Sweat” concludes that: “Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.” On Friday the Dallas County Health Department released a statement explaining that HIV is most commonly spread through sexual contact, sharing needles, or transfusion from an infected blood product.

Virgin Media investors want to discuss company’s strategy

Virgin Media announced weak results last week, in part due to competition from Sky. Virgin Media lost 47,000 customers from January to March 2007, while Sky gained 51,000 customers in the same time period.

Franklin Mutual Advisers, which has 9.4% of the Virgin Media shares (Sir Richard Branson owns 11%) wants to have a meeting with Virgin Media about its “strategic direction, corporate governance and management”. Franklin Mutual Advisers is known to take great interest in the companies in which it invests.

This has caused many of the other investors of Virgin Media to demanding meetings with the management of the company. The demands are due to confusion among shareholders at the direction in which the company is heading, The Guardian reports. After the attempt to buy ITV was stopped last year, the shareholders think that Virgin Media may lose its battle with Sky and TalkTalk.

Another issue causing concerns amongst investors is the £25.2 million pay cheques for the top seven executives of Virgin Media. Virgin Media reported a £15.3 million loss last year.
