A power of attorney is a legal document wherein one person (the Granter/Principal) appoints another person or organization to act as an agent on his or her behalf. The granter delegates his authority to the agent to perform certain acts or functions on his behalf. The person or organization you appoint is referred to as an “Attorney-in-Fact” or “Agent”. Legal will and power of attorney has a close relationship. Whenever a testator creates a Will, he definitely requires a person to enforce his Will according to his wishes. Therefore, executor works in the same way as an agent work in power of attorney forms.

Purpose of Power of Attorney

Coming to power of attorney, it enables a principal’s affairs to be managed by a person of their choice when they are unable to conduct them personally, such as if they are ill, traveling overseas or become mentally incapacitated. A powers of attorney will usually end either at a specified time or upon the request of the principal at any time using a power of attorney revocation and will automatically be revoked if the donor loses mental capacity. General Power of Attorney: This is where you appoint someone, usually for a specific period of time, to make financial or legal decisions for you.

Health Care Power of Attorney: A Health Care Power of Attorney is a document that allows you to designate a person (an “Agent”) who will have the authority to make health care decisions on your behalf if you are unconscious, mentally incompetent, or otherwise unable to make such decisions

Special Power of Attorney: A special power of attorney allows you to give only specific powers to the person or organization you appoint as your Agent. For example, you could authorize someone to sell a car or a house for you.

Why the document is useful

The general power of attorney would be useful if, for example, you are selling your home and the exchange of contracts is due to take place around the time when you will be away on holiday. Then, if there are problems while you are away on holiday – e.g. a last minute amendment to what is included within the fixtures and fittings of the property – these amendments can be signed off by your ‘attorney’ under your general power of attorney. Failure to have a power of attorney in place may mean that, in this scenario, you cannot complete the paperwork in the proper form accepted by solicitors and Land Registry for a property sale even if you fully know and have agreed to all the amendments.

Remember that in giving a power of attorney to someone, you are basically giving up all your powers in favour of your attorney. For instance, your agent has full right to agree or refuse to sign a contract on your behalf. If the agent turns out to be corrupt, then any transaction that he handles is at risk for fraud. Thus, giving that kind of power to one person can be very risky even if you plan to monitor all the transaction made in your name.

Deciding Who to Appoint

You need to make this decision for yourself. You can choose any adult to be your agent. You should try to appoint someone who you have grounds for believing is trustworthy and who both knows you well enough, and is objective enough, to make the decisions that are best for you.

Powers of Agent/Attorney

What are the Public Guardian’s responsibilities?

All continuing and welfare powers of attorney must be registered with the OPG who will maintain a Public Register. The Public Guardian also has a statutory obligation to notify the appropriate local authority and Mental Welfare Commission of any welfare powers of attorney which have been registered. Once a power of attorney has been registered with this office, the Public Guardian will return the signed power of attorney and issue a Certificate of Registration to the sender. The Certificate can then be used by the Attorney immediately in the case of a continuing power of attorney if this is the Granter’s wish, or it can be kept safe until such times as the Granter has lost capacity or wishes the Attorney to act on his/her behalf. A welfare Attorney however cannot exercise any of the welfare powers granted until the Granter has lost capacity.

Can the Power of Attorney be Revoked?

The Granter can revoke a continuing or welfare power of attorney or any of the powers granted in it once it has been registered with the Public Guardian. The granter must give notice of the revocation in writing.

Why Revoke a Power of Attorney Some reasons include:

The power of attorney is no longer necessary as you are now able to act on your own behalf; You no longer trust your attorney; You have found a more suitable candidate to act as your attorney; It is no longer practical to have your attorney acting on your behalf (e.g. your attorney no longer resides in the same jurisdiction as you do); and The purpose of the power of attorney has been fulfilled and you no longer need an attorney to act for you.

Deed of Revocation of Power of Attorney A revocation of a power of attorney is not effective against the attorney or any third party (e.g. bank) until notice of the revocation has been received by that party. Consequently, it is a good idea to have a written document as evidence of your revocation to make sure there is no doubt as to your intention to revoke the power.

A power of attorney can be revoked at any time. And you are not required to explain why you are revoking your power of attorney.

Effective Revocation of Power of Attorney

Upon the signing of the Deed of Revocation, a witness shall be required to counter sign the Deed to confirm that you are the correct person and that you have chosen to revoke power of attorney that is in place. The Deed of Revocation document and copies of such must be given to the attorney and any third parties who are involved in the matter. Born in Saskatoon, he graduated from the University of Saskatchewan in 2003, with a B.Sc. with Great Distinction in Computer Science; he received a University Medal in Science. Having worked for several area businesses, this is his first political run. A longtime member of Fair Vote Canada, he currently serves on the Libertarian Party’s ethics committee.

Wikinews contacted Kevin, to talk about the issues facing Canadians, and what they and their party would do to address them. Australia: Mat Morgan, Greens candidate in South Gippsland, talks climate, tourism, and local issues with Wikinews

Since June 2019, the people of South Gippsland Shire, located at the southernmost tip of Australia, have been without a local council, after a state government inquiry found “high levels of tension” within the council. Administrators were appointed by the Victorian state government in July 2019, who have governed the shire since then. However, South Gippsland’s council is scheduled to be restored with an election to be held via post from October 5-22, 2021.

Wikinews interviewed one of the candidates standing in this election, Mat Morgan. He is running as a candidate in the Coastal-Promontory Ward, and is endorsed by the Australian Greens. The Coastal-Promontory ward covers towns such as Venus Bay, Waratah Bay, Yanakie, Foster, Port Welshpool, and Toora, and elects three councillors to the South Gippsland Shire Council.

Parts of internet break as ‘512k day’ reached by routers

On Tuesday many internet routers, used to find the pathways to different parts of the web, reached their memory limit of 512,000 entries in the tables they use to store the routes, causing problems for many users.

A router is used to direct a user towards the area of the internet where they will find the content they are looking for, e.g. a web page. The recent problem was caused by the arbitrary memory limit built into the design of many aging routers. A limit was needed to prevent the cost of hardware from becoming prohibitively expensive in the days when physical data storage was still comparatively expensive. This small amount of memory in turn limits the number of directions which can be stored on a single router leading to different parts of the internet. When this limit was reached, it caused outages of services among Internet Service Providers. Many routers, including older ones provided by Cisco Systems Inc., are limited to storing a total of 512,000 routes or paths.

This limit was reached on Tuesday, reported to have been triggered by Verizon publishing another 15,000 paths. Those affected included eBay, LastPass, and clients of the web hosting company Liquid Web, who lost much of their services until Verizon withdrew some of these new paths. Problems nevertheless continued throughout the day, even after the withdrawal.

A longer term fix is possible, but it would require manually replacing old routers with newer, more capable ones. It is hard to tell what issues would temporarily cascade though the internet by taking down routers from part of the internet for maintenance. Many experts have warned that problems could continue until these difficult fixes have been implemented, although the recent switch to a newer form of IP Addresses, IPv6, will temporarily help the issue. Wired News reported that Andre Toonk, a network engineer, had stated that the number of network outages on the internet, typically around 1,500, yesterday peaked at 2,587, enough to become clearly noticeable.

Sony refreshes VAIO brand for business and entertainment

From the middle of July, Sony Corporation refreshed their senior laptop brand VAIO from “Video Audio Integrated Operation” to “Visual Audio Intelligent Organizer”. According to Sony Taiwan Limited, this refreshment is an attempt to relocate the laptop consuming market for business and entertainment factors.

Turkish government stops search of survivors of Aegean Sea earthquake off Izmir

On Wednesday, the Tuskish government declared they were officially ending the search of survivors of the earthquake in the Aegean Sea. Reports said at least 116 people died due to this earthquake, while the number of casualties rose to at least 1,035 in Turkey and about 19 in Greece.

On the Greek island of Samos, two people died when a wall collapsed. The disaster caused buildings on Samos and in the west coast city of Izmir, Turkey, to collapse or be severely damaged. The earthquake also caused a “mini tsunami” to flood some streets of Samos and Izmir.

The earthquake occurred on Friday with its epicentre in the Aegean Sea near Samos. Turkey’s Disaster and Emergency Management Presidency reported the magnitude of the earthquake was 6.6 and, as of Wednesday, 1885 aftershocks had occurred since the earthquake. The US Geological Survey reported it was of 7.0 magnitude.

Local officials said on Saturday, about 20 buildings collapsed. Early reports suggested police and people used simple tools such as chainsaws to rescue people who were trapped.

Turkey and Greece had earlier had poor relations over disputed resources in the Mediterranean, but the leaders of the two countries spoke by telephone on Friday night, and publicly expressed their willingness to help each other.

Daughter of Yuko Ikeda kidnapped to ransom in Tokyo; freed 13 hours later

Ikeda Kanako, a 21-year-old senior student of the Meiji Gakuin University and the first daughter of celebrity surgeon Yuko Ikeda, was kidnapped at about 1225 (UTC+9), June 26, 2006, in Shibuya, Tokyo.

A bullet was fired and one officer slightly cut when police stormed a Kawasaki apartment to rescue the girl.

Kanako was dressed in a white light half-sleeved cardigan, blue jeans with a bistre belt made of leather, a spring green camisole and carried a bag of Vuitton when she was abducted at a bus stop.

She was found unharmed 13 hours later by Japanese police at a condominium located in Nakahara-ku, Kawasaki, Kanagawa. The young woman’s make-up was not disordered; Kanako’s long brown fringe was not disheveled at all and she was wearing what she had been when she was kidnapped.

The kidnapping of Kanako was a big story in Japanese media in June, 2006. The story appeared in many newspapers as the front-page news on June 27, 2006.

Kanako and her kidnappers had been in touch with her mother using Kanako’s mobile phone. The effort to free her was helped greatly by a woman who witnessed the moment Kanako was taken; she wrote down the license plate of the van and other details.

Police traced mobile phone calls and were able to locate the van in Kawasaki where they detained two of the kidnappers as they went shopping.

One conspirator Li Yong, 29, from China, led the policemen to the apartment and tricked Kaneo Ito, 49, from Japan, to open the door. Ito managed to discharge one bullet before being restrained by an assistant police inspector, the first man in the room.

The other man involved in the kidnap of Kanako was Choi Gi Ho, 54, from South Korea. Kanato was freed unharmed.

The Tokyo Metropolitan Police Department arrested three men on suspicion of conspiring to kidnap a woman and hold her to a reported 300 million yen ransom.
